Item descriptionWelcome to Buchholz Home Team, LLC. By engaging our services, utilizing our website, or partnering with our agents, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.
1. Brokerage Identity and Affiliations
Legal Entity: Buchholz Home Team, LLC is a registered limited liability company operating as an independent real estate brokerage in the State of Wisconsin. Brittney Buchholz is the Registered Broker & Owner of Buchholz Home Team, LLC (WI Broker License #51580-90).
Professional Affiliations: Buchholz Home Team, LLC is a proud member of the Wisconsin Realtors® Association (WRA) and the South Central Wisconsin Multiple Listing Service (SCWMLS). We strictly adhere to the National Association of Realtors® (NAR) Code of Ethics and all applicable Wisconsin real estate laws.
2. Agency and Real Estate Contracts
Contractual Agreements: Real estate contracts entered into with Buchholz Home Team, LLC (including, but not limited to, Buyer Agency Agreements, Listing Contracts, and Offers to Purchase) are legally binding agreements subject to Wisconsin State Law.
Brokers vs. Agents: All formal agency agreements are entered into with Buchholz Home Team, LLC as the firm, not with individual real estate agents.
Modifications: No amendment or modification to an active real estate contract shall be valid unless it is executed in writing and signed by all necessary parties.
3. Consumer Disclosure: Client vs. Customer Relationships
Under Wisconsin law, a real estate brokerage owes different duties depending on whether you are a "Customer" or a "Client." By working with Buchholz Home Team, LLC, you acknowledge that you understand this distinction:
You are a Customer by default until you sign a formal, written agency agreement (such as a WB-36 Buyer Agency/Tenant Representation Agreement or a WB-1 Residential Listing Contract). As a Customer, Buchholz Home Team, LLC represents the other party in the transaction (or acts as a neutral transaction coordinator). We owe you the duties of fair, honest treatment and the disclosure of material adverse facts, but we cannot provide you with negotiation strategies, advocate on your behalf, or suggest specific pricing.
You become a Client only when you execute a written agency contract with Buchholz Home Team, LLC. As a Client, you can be assured that the firm and its agents strictly represent your best interests. We owe you the full suite of Wisconsin statutory duties, including loyalty, confidentiality, providing information and advice on real estate matters, and advocating strongly on your behalf during negotiations.
DSPS & Regulatory Compliance: Buchholz Home Team, LLC is a licensed Real Estate Business Entity credentialed and regulated by the Wisconsin Department of Safety and Professional Services (DSPS) and the Wisconsin Real Estate Examining Board (REEB). All real estate licensed activities, agent associations, and trust account practices are conducted in strict compliance with DSPS regulations under Wisconsin Statute Chapter 452.
Important Notice: No verbal agreement can establish a client-agency relationship in the State of Wisconsin. Buchholz Home Team, LLC will provide all consumers with the mandatory DSPS/REEB Broker Disclosure to Customers form at the start of our professional relationship to formally outline these duties.
4. Fair Housing Commitment
Buchholz Home Team, LLC is fully committed to the principles of the Fair Housing Act and Wisconsin Open Housing law. We provide equal professional services without regard to race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other protected class.
5. Accuracy of Information and MLS Data
Property Listings: While Buchholz Home Team, LLC strives to provide accurate and up-to-date information on our website and marketing materials, all data (including square footage, acreage, and property conditions) is derived from various sources, including the SCWMLS. It is deemed reliable but not guaranteed.
Buyer/Seller Responsibility: Buyers and sellers are strongly encouraged to independently verify all material facts, property dimensions, and school districts prior to closing.
6. Limitation of Liability
Third-Party Referrals: Buchholz Home Team, LLC may provide recommendations for third-party service providers (e.g., home inspectors, lenders, title companies, contractors). Buchholz Home Team, LLC does not guarantee the performance, services, or products of these third parties, and clients are free to select any provider of their choosing.
Legal and Tax Advice: Buchholz Home Team, LLC agents provide real estate brokerage services. They are not attorneys, home inspectors, tax advisors, or financial planners. Clients should consult with qualified professionals for legal, tax, or structural advice.
7. Privacy and Communication Consent
By providing your contact information to Buchholz Home Team, LLC, you consent to receive communications from us (including phone calls, emails, and text messages) regarding your real estate transactions, market updates, and relevant services. You may opt out of these communications at any time.
8. Governing Law
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Wisconsin. Any legal action arising from these terms or our services shall be filed exclusively in the appropriate court of jurisdiction within the State of Wisconsin.
9. Limited Liability Company (LLC) Disclaimer
Limitation of Personal Liability: You explicitly acknowledge and agree that Buchholz Home Team operates as a Limited Liability Company (LLC). All real estate brokerage services, consultations, contracts, and representations are provided solely by the entity, Buchholz Home Team, LLC, and not by its individual members, managers, owners, employees, or independent contractor agents in their personal capacities.
Recourse Restriction: By engaging our services, you agree that any legal claims, liabilities, damages, or losses arising out of or relating to a real estate transaction, advice, or service provided by Buchholz Home Team, LLC shall be brought exclusively against the LLC entity. To the maximum extent permitted by Wisconsin law, you waive any right to seek personal recourse, financial damages, or judgments against the personal assets of any individual agent, member, manager, or owner of Buchholz Home Team, LLC.
10. Disclaimer and Client Due Diligence
Informational Purpose Only: These Terms and Conditions, along with any content, advice, or marketing materials provided by Buchholz Home Team, LLC, are for general informational and organizational purposes only. Real estate laws, local regulations, and market conditions vary widely and evolve rapidly.
Client Responsibility for Due Diligence: It is the sole responsibility of the client (buyer, seller, or user) to conduct independent due diligence, verify all material facts, and investigate all aspects of a property or transaction before making any financial or legal commitments.
Professional Counsel: Buchholz Home Team, LLC does not provide legal, tax, or structural engineering advice. Clients are encouraged to seek independent counsel from licensed attorneys, certified public accountants, and certified home inspectors to protect their own interests.
